The AJC Files its First-Ever Interim Injunction Application against the Attorney General of Canada

On May 18, 2016, the AJC filed an interim injunction application against the actions of the Public Prosecution Service of Canada (PPSC) seeking an order prohibiting the requirement of federal prosecutors to conduct Alberta JP bail hearings in addition to their current full-time excessive workload.  

Alberta is the only province in the country that conducts bail hearings twenty-four hours a day, seven days a week.  Prior to April 29, 2016, police officers conducted these JP bail hearings.  The province of Alberta has not yet imposed these bail hearings on their provincial prosecutors and is examining the implications relating to the recommendations contained in the Irving Report.   Police officers in the province are continuing to conduct these hearings in relation to matters within provincial prosecution jurisdiction.  The question of, what gave rise to PPSC taking on this extra responsibility without having the infrastructure and additional resources in place, remains unanswered.  The AJC has filed an access to information request.  

This interim injunction application follows the May 9, 2016 PSLREB unfair labour practice complaint the AJC filed against PPSC for violating the statutory freeze period during which terms and conditions must remain unchanged and the subsequent open letter that the AJC sent to the federal Minister of Justice and Prime Minister's Office.  The AJC has not yet received a response to the letter.
