Federal Court Challenge by a Justice Lawyer

According to a Globe and Mail article, Edgar Schmidt, a Department of Justice lawyer (LC) who is not a member of the Association, is challenging in Federal Court the Department of Justice on the basis that Parliament should be informed when Justice lawyers are asked to craft legislation that risks running afoul of the Charter of Rights and Freedoms.

There appears to be some preliminary debates on jurisdiction at present and whether Mr. Schmidt should first be going to the Office of the Public Sector Integrity Commissioner of Canada to make a disclosure.

The AJC is monitoring closely this matter and is inviting members who face a potential similar issue in their workplace to contact the AJC.
