CAO Holds Hearings on AJC's ERA Charter Challenge

Following a November 1, 2011 ruling where the wage restraint provisions in the ERA relating to the 2006-2007 fiscal year were declared unconstitutional on the basis that they violated federal lawyers' and prosecutors' right to collectively bargain, Justices Robert P. Armstrong, Sarah E. Pepall and Robert J. Sharpe of the Court of Appeal of Ontario heard the appeal filed by the AG and a cross appeal filed by the AJC on June 13, 2012.

The Court of Appeal will also consider the AG's appeal of Mr. Justice Duncan Grace's decision to award costs of $ 135,000 in favour of the AJC following his ruling on the Association's ERA Charter Challenge before the Ontario Superior Court.

The hearing of the appeal has generated extensive media coverage in the Toronto Star, the Canadian Press, Droit-Inc.com and local radio stations in Ottawa to name a few.

The AJC's counsel, Andrew Lokan, ably represented the Association in his pleadings and representations before the Court of Appeal.  The Court reserved its decision. We will advise of the outcome of these proceedings as soon as they are released.
