TB Responds Positively to 2 Pay-Related Policy Grievances: Late Lump-Sum Performance Payouts and Late Lockstep Increases for LPs. But is it Enough?

The AJC has received a decision from Treasury Board, the employer, admitting that it failed to comply with the collective agreement in respect to the payment of performance awards and lockstep increases by May 10th 2016.  The employer also committed to issuing an annual reminder to user departments and agencies regarding the steps to be taken to ensure compliance with the May 10 performance award pay out and increment dates.

TB notes that most eligible AJC members did however receive their lump-sum performance pay awards by June 1, 2016 and that all late lockstep pay increases are retroactive to either May 10 or a lawyer's appointment date, as the case may be.  

While these admissions are appreciated, they fall short of ensuring immediate compliance, a formal enforcement mechanism and ensuring future compliance.  The system and processes need to be fixed and proactive measures are required to address future anticipated non-compliance. No doubt, there needs to be a built-in incentive to comply.  

The AJC has therefore referred the matter adjudication notwithstanding these concessions from TB as they fall short of what we are seeking. The decision to adjudicate may be revisited should other developments occur in the meantime that address the AJC's concerns.
