The PSLRB Rules in Favour of the AJC in its First Job Content Grievance

The adjudicator has confirmed that DOJ had violated section 33 of the collective agreement on the basis that the grievor's job description was not complete and accurate.

AJC members are sometimes being asked to accomplish more demanding and complex duties beyond their current classification level, without being properly compensated.

The AJC's very first job content grievance before the Public Service Labour Relations Board was heard on May 1-2 and July 30-31, 2014.  

In the PSLRB's ruling, adjudicator Potter confirmed that the Department of Justice had violated section 33 of the collective agreement on the basis that the grievor's job description was not complete and accurate.  In essence, the Department of Justice had asked the grievor to do work that fell outside the scope of her existing job description, some of which consisted of work from a higher classification level.

Accordingly, the adjudicator ordered certain amendments to the grievor's job description.  Click here to access the PSLRB Decision.  

The next steps to this process will require a formal amendment of the grievor's job description and a new classification decision based on the amended job description.
 
While there is no guarantee that this outcome will result in an upward reclassification, this amended job description opens the door to such a possibility.  Much will depend on the impact these additional amendments will have on the position's overall weighted averaging, as determined by a classification committee.
