The Federal Government Attacks Collective Bargaining Rights With Omnibus Bill

The scope and breadth of these changes came as a shock yesterday to the AJC and other public sector unions.

The federal government's latest omnibus budget bill contains several measures that weaken public sector unions with important amendments to the Public Service Labour Relations Act (PSLRA).

The scope and breadth of these changes came as a shock yesterday to the AJC and other public sector unions.

We want to bring to your attention the article published in today's Ottawa Citizen (Wednesday, October 23, 2013), where AJC President Lisa Blais is quoted.

You will find the amendments to the PSLRA in Division 17 of the bill.

What is clear is that this bill:

- Removes the right of unions to select arbitration as a mode of settling labour disputes (arbitration would only be an option if the employer agreed to this process);
- Gives the government unilateral power to decide which employees provide an 'essential service';
- Employees in bargaining groups where the government has designated 80 % to be essential will only be allowed to seek arbitration to settle impasses;
- Amends the factors that conciliators and arbitrators can consider when making an award or report - primary considerations for any settlement will be the state of the economy/the country's fiscal situation and whether the government faces a problem recruiting or attracting employees at the existing salaries.


'This legislation virtually eviscerates meaningful collective bargaining for public servants', said Lisa Blais, President of the Association of Justice Counsel.
