ERA Charter Challenge: AJC Files Reply Memorandum of Argument

On November 19, 2012, the Association of Justice Counsel filed its Reply Memorandum of Argument in response to the Attorney General's recent request  that the AJC's Application for Leave to appeal be dismissed.

In its Reply Memorandum of Argument, the AJC stressed that the Attorney General's request does little to address the matters raised by the Association and actually mischaracterizes the AJC's position.

The Association reiterated its position that the ERA took salaries off the bargaining table for a period of five years which perpetuated below-market salaries for federal government lawyers whose compensation had never been established by collective bargaining.

Prior to the enactment of the ERA, the AJC and Treasury Board were engaged in a process of collective bargaining up until the ERA was announced following which any representations the AJC made in regards to wages were ignored by Treasury Board.  

The Attorney General does not dispute that the case raises issues of public importance because of its wide-ranging impact. The AJC remains hopeful that the application will be allowed to proceed to the Supreme Court.
